SOURCES AND COLLECTION OF PERSONAL INFORMATION

Voluntarily Submitted Information.

  • Identifiers and contact details: full name, email address, and phone number (if provided);
  • Business information: Shopify store URL, current monthly revenue range, monthly ad spend range, decision-making role, investment timeline, advertising channels, and free-text answers describing your business (for example, your biggest bottleneck or what a revenue increase would mean to you);
  • Communications content: the content of any email, application response, or other communication you send to us; and
  • Other information you choose to provide in your interactions with us.

If you do not want us to collect this type of personal information, please do not provide it. Voluntarily providing information is strictly your choice. Not providing personal information may limit your ability to take full advantage of the Website, but it will not affect your ability to access certain information available to the general public on the Website.

Automatically Collected Information.

When you visit our Website, we and certain service providers operating on our behalf, as well as third parties, may collect information about your activity, or activity on devices associated with you, on our Website and on third-party sites and applications, using tracking technologies such as cookies, pixels, tags, application program interfaces, and web beacons.

  • Legally Compelled Disclosures: We may disclose your information, including personal information, to government authorities, and to other third parties when compelled to do so by such government authorities, or at our discretion or otherwise as required or permitted by law, including but not limited to responding to court orders and subpoenas.
  • To Prevent Harm: We may disclose your information, including personal information, when we have reason to believe that someone is causing injury to or interference with our rights or property, other users of the Website, or anyone else that could be harmed by such activities.
  • Business Transfer: If we or any of our affiliates, or substantially all its or their assets, are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation, or liquidation, personal information may be one of the transferred assets.
  • Service Providers and Business Partners: We may share your information, including personal information, with our service providers and other third parties with whom we have a contractual relationship. Our current key service providers and partners include Meta Platforms, Inc. (Meta Pixel and Conversions API for ad attribution and delivery), Microsoft Corporation (Clarity session replays and heatmaps), HighLevel (LeadConnector, our CRM and scheduling platform), Tally (our application form host), and Vercel Inc. (our website hosting provider).

DATA RETENTION

We retain personal information for as long as we deem it reasonably necessary to maintain and expand our relationship and provide you with our Website and services; in order to comply with our legal and contractual obligations; or to protect ourselves from any potential disputes (i.e., as required by laws applicable to log-keeping, records and bookkeeping, and in order to have proof and evidence concerning our relationship, should any legal issues arise following your discontinuance of use), all in accordance with our data retention policy.

YOUR CHOICES

Depending on where you are located (e.g., California, Colorado, the European Union, the United Kingdom), you may have certain rights regarding your personal information:

  • Your Right to Know and Right of Data Portability: You have the right to request that we provide certain information to you about our collection and use of your personal information. In such case and if the right applies, the respective personal information will be marked and may only be processed by us for certain purposes.
  • Right to Object to Processing: You have the right to object to our processing of your personal information, under certain conditions, and we can be required to no longer process your personal information. Such a right to object may not exist if the processing of your personal information is necessary to take steps prior to entering into a contract or to perform a contract already concluded.
  • Right to Withdraw Consent: Where we rely on your consent to process your personal information, you have the right to withdraw that consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal.
  • Right to Opt-Out of the Sale or Sharing of Personal Information: We do not, and have not in the preceding 12 months, sold your personal information (disclosed your personal information to a third party in exchange for monetary compensation or other valuable consideration). However, we have shared (in this context, “share” means use of your personal information for cross-contextual behavioral advertising) your personal information, in particular with Meta for advertising purposes.   • You Can Opt-Out Of Receiving Our Marketing Emails: When you submit our application form or otherwise provide us with an email address, you acknowledge that we may use your email address to communicate with you about our services (unless affirmative consent is otherwise required by applicable law). To stop receiving our promotional emails, you may email us at partners@foundrev.com or follow the instructions in any promotional message you get from us. Even if you opt out of marketing messages, we may still contact you through email in response to your questions or in relation to services we are providing you.
  • Non-Discrimination: You have the right to not be discriminated against in pricing and services because you exercise any of your rights described above.
  • Exercising Your Rights: Please note that many of the above rights are subject to exceptions and limitations, and our responses will vary based on the circumstances of the request and on your location. If you choose to assert any of these rights under applicable law, we will respond in accordance with and within the time-period prescribed by such law.

If you are located in the State of California in the United States, a person authorized to act on your behalf may make a verifiable request related to your personal information. If you designate an authorized person to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent permission to make a request on your behalf.

When you submit a request, your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

CHILDREN’S PRIVACY

Federal law imposes special restrictions and obligations on commercial website operators who direct their operations toward, and collect and use information from, children under the age of 13. We do not intend for our Website or services to be used by children under the age of 18. If we become aware that anyone under the age of 18 has submitted personal information to our Website, we will delete that information and will not use it for any purpose whatsoever. HOW WE PROTECT COLLECTED PERSONAL INFORMATION

TRACKING TECHNOLOGIES

We Use Common Tracking Technologies. Like many websites, we use digital tracking technologies such as cookies, pixels, web beacons, and similar technologies (collectively, “Cookies”) to record your preferences, track the use of our Website, and for the related purposes described below. We may also use these technologies to monitor traffic, improve the Website, and make the Website easier to use and more relevant.

Your browser or device may include “Do Not Track” functionality. Our Website is not built to respond to such Do Not Track signals.
